Costa Rica Trip Official Raffle Rules
 

The Costa Rica Trip raffle is conducted by Beth Shalom Congregation of Carroll County ("Beth Shalom"), a not-for-profit corporation organized under the laws of Maryland. These Rules govern the raffle and, by purchasing a raffle ticket, you agree to be bound by these Rules.

 1. You must be 23 years of age or older and must qualify under Maryland law to purchase a raffle ticket and participate in this raffle.

2.  The purchase price for one raffle ticket is $50.00. No more than 1,000 tickets will be sold.  If an entrant's check is dishonored by the bank, the entry ticket will be invalid unless full payment is received by Beth Shalom by September 12, 2009 prior to the time the raffle closes. The raffle closes at 4:00 p.m. September 11, 2009.  . Any monies turned in after the raffle closes will be returned to the entrant.

3.  If 1,000 raffle tickets are sold before the raffle closes, each ticket will have a 1-in-1, 000 chance in winning, and the Prize will be: (1) a seven night stay at La Gaviota located in Playa Jurel in the Guanacaste Province in Northwest Costa Rica (Pacific Ocean side) having a fair market value of approximately Two Thousand Dollars ($2, 000.00) (transportation to and from La Gaviota, and expenses during the stay at La Gaviota, are excluded and are the sole responsibility of the winner) and (2) One Thousand Dollars cash ($1,000.00) (hereinafter collectively referred to as the "Prize").  All information concerning La Gaviota is posted at www.costaricaluxuryvilla.com and Beth Shalom makes no representations whatsoever concerning La Gaviota.  The winner agrees to comply with all the terms and conditions as set forth at www.costaricaluxuryvilla.com.

4.  The stay at La Gaviota must be scheduled within twelve months (12) of the date of the drawing.  All arrangements for the stay at La Gaviota shall be made by and between the winner and the owner of La Gaviota.  Beth Shalom shall make all information available to the winner for the purpose of scheduling the stay at La Gaviota.  If the stay at La Gaviota is not scheduled within the twelve-month period, the stay is forfeited. 

5.  The Winner will be determined by random drawing. The drawing will take place on September 12, 2009, at approximately 8:30 p.m. EST, at Beth Shalom Congregation of Carroll County located at 2020 W. Liberty Road, Westminster, Maryland 21157.  Winner need not be present. Winner will be notified by telephone and mail.

6.  Purchasers of raffle tickets must legibly write their full names, addresses and telephone numbers on each ticket.  If more than one name is stated on a raffle ticket, the first listed name shall be the Entrant. Beth Shalom has no obligation for payment or delivery of the Prize to any person other than the entrant. It is the sole responsibility of the entrant to allocate the Prize among the participants in any multiple party entry.

7.  The winner of the raffle must claim the Prize within 30 days of the drawing. If the winner does not claim the Prize within 30 days of the drawing, by responding to telephonic or written or email notice from Beth Shalom, the Prize will be forfeited and will be retained by and for the benefit of Beth Shalom.  No substitutes for the Prize will be made. The winner assumes all local, state and federal income taxes and incident expenses not mentioned herein.

8.  If the winner cannot be located by 5:00 p.m., October 12, 2009 after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited his or her Prize, and another winner will be selected for the Prize. The name of the winner may be obtained by a request, in writing, to Beth Shalom, together with a self-addressed, stamped envelope, postmarked no later than October 12, 2009.

9.  The winning trip can be transferred to anyone 23 years of age or older.  By purchasing a raffle ticket, you, and any transferee, agree to be bound by these Official Rules and the decisions of Beth Shalom, which shall be final.  By purchasing a raffle ticket, you and any transferee, agree to be bound by the rules set forth in the Guest Responsibility Agreement as posted on the La Gaviota website www.costaricaluxuryvilla.com. The winner will be required to execute an affidavit of eligibility and a publicity release permitting Beth Shalom to use his or her name, photograph, likeness and voice for promotional purposes in any media.

 10.  Beth Shalom is not responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner’s acceptance or use of the Prize. By entering the raffle, each participant releases Beth Shalom, its directors, officers, employees, and agents from any and all liability for injuries, losses or damages of any kind caused by the Prize or resulting from acceptance, possession, use or misuse of the Prize, and the winner agrees to indemnify and hold Beth Shalom harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s acceptance or use of the Prize.

11.  The drawing may be postponed due to weather or any state of emergency declared by the Mayor of Westminster, the Chief Executive of Carroll County, Maryland, the Governor of Maryland, or the President of the United States. In such event, a new date, place and time for the drawing will be determined by Beth Shalom, which will be posted at Beth Shalom and on Beth Shalom's website.

12. No refunds are available. Beth Shalom assumes no responsibility for lost, late, misdirected or non -delivered mail or other failure to deliver tickets to Beth Shalom prior to any deadline.

13.  Any and all disputes, claims and controversies concerning this raffle shall be resolved by the Board of Directors of Beth Shalom and the decision of the Board of Directors shall be final and binding.
